The implementation date of the act is subject to the Judicial Yuan's decision but it is expected to take effect in January 2020. The purpose of the act is to facilitate effective resolutions of labour disputes\, protect labourers’ rights in all dispute resolution proceedings\, and ensure symmetry of information and equal footing for both the labourer and the management so that the parties have a chance to resolve disputes by mutual agreement. \nThe act aims to resolve labour disputes more effectively through court-appointed mediation. Under the terms of the act\, if a dispute is not resolved through mediation\, the employer will bear the burden of proof with respect to salary and overtime pay calculations. In addition\, employers are required to review their HR policies in response to the enactment of the act. They should also note what responses should be made at different stages of labour disputes. \nThis event\, hosted by the ECCT’s Luxury Goods committee\, is being held to raise awareness of employers’ challenges when a labour dispute is brought to court as well as to outline the appropriate response before a labour dispute lawsuit becomes imminent.  At the event\, our guests will engage in a panel discussion on the following topics\, among others: \n\nA general introduction of the Labour Dispute Act\nAppropriate responses of employers to labour disputes.      \n\nAbout the speaker \nLawrence Yu is a partner in the Corporate Department of Lee and Li Attorneys-at-Law and a member of the firm’s Labour and Employment Practice Group. He specializes in employment issues (including wrongful termination\, discrimination claims\, claims for severance pays and retirement benefits\, and claims for occupational accidents) as well as mediation\, arbitration\, administrative proceeding and collective bargaining. He has represented clients in various commercial disputes over insurance\, copyright\, consumer protection\, product and professional liability\, unfair competition and trade secrets. Recently\, he has successfully defended an international insurance company against a copyright infringement claim.
